Joshua M. Dickey’s litigation practices focuses on complex civil disputes in such areas as commercial law, corporate law, business torts and healthcare law. In addition to his litigation practice in the trial and appellate courts, Mr. Dickey advises clients on matters concerning corporate governance, trade secrets and covenants not to compete.

Representative Matters

•Tried case on behalf of charitable organization in which a donor sought $2.5 million in damages on numerous claims including fraud, breach of contract, breach of the implied covenant of good faith and fair dealing, breach of fiduciary duty, and conversion, resulting in complete victory for the charity on all claims and zero damages to the donor.

•Defended attorney for state agency in civil rights and defamation action brought by regulated entities resulting in favorable settlement, after the filing of attorney’s motion for summary judgment, in which plaintiffs agreed to abandon their claims and dismiss them with prejudice and further agreed to pay attorney a nominal sum even though the attorney did not assert any counterclaims.

•Represented clients accused of misappropriating trade secrets of company for which they formerly worked, resulting in a walk-away settlement shortly after trial began.

•Tried a case on behalf of a contractor resulting in a verdict and substantial award of attorney’s fees in favor of the contractor on its breach of contract and mechanic’s lien claims, and the dismissal of a construction-defect based counterclaim against it.

•Second-chaired a jury trial that resulted in a verdict in excess of two million dollars in favor of client arising out of a gaming company's failure to honor an agreement requiring it to convey stock to the client in return for the client’s services in facilitating an initial public offering.

•Represented attorney in a challenge to constitutionality of a Nevada Supreme Court Rule preventing law firms from using "artificial" trade names resulting in the rule being stricken as unconstitutional.

•Represented board of directors of gaming company in a derivative action resulting in a favorable non-monetary settlement shortly after the filing of the director's motion to dismiss.

•Represented gaming companies in a putative nationwide RICO class action involving tens of millions of potential class members resulting in the denial of class certification by the United States District Court for the District of Nevada.

•Represented grocery store chain in litigation with slot route operators resulting in favorable settlement for client in which, among other things, the client was indemnified for its attorneys' fees.

•Represented hospital and healthcare company in contract dispute with managed care company resulting in extremely favorable settlement.
